Can my insurance company deny my theft of scooter claim?

Hi, I bought a scooter back in June 2008.I bought it as id changed jobs and was travelling further to work. I got insurance for the scooter..however,i never actually rode it as i didn't feel confident.So i didnt do the CBT.When i applied for insurance it didnt ask anywhere if i had the CBT so i didnt decept them into thinking i had done it. The bike was garaged from when i bought it until December 2008 when the scooter was stolen. Just had letter from the insurance stating they wont pay out as i didnt have a CBT! Can they do this?

  1. Are you sure there is nothing in the "fine Print" of the insurance policy that you signed that states that you must have a CBT to be fully insured? I would pull out your policy and read it, or bring it down to the insurer and let them show you where this is stated. If you did not sign anything that stated you must carry a CBT then you have a case that can be won.
