ID Theft

Can I still prosecute someone in VA or MD for id theft that occured over 4 years ago?

I knew the culprit, he attacked my social and my spouses. This was over 4 years ago. Is their some sort of statue or time frame that keeps me from prosecuting him and her (his new spouse) today? He has come forward and paid all the debt to me and my current spouse. The problem is, I also have a child with him. How will this affect her? Is ID theft a misdemeanor or felony and will there be jail time? He has threatened me in many ways, very abusive and I'm not sure I can still prosecute after all this time. My spouses and my credit report have been repaired. Please help.

  1. This might also be federal. Why do you need to prosecute now , after you have waited this long? The laws about ID theft have changed. Since this crossed state lines, it might also qualify for federal prosecution.
  2. Although there is no limit on time, all is about evidence. How can you validate your evidence? How have you maintained the chain of custody on your evidence? You can place persecution but the defendant anthorny can easily erase them all.
