My car was unregistered but had insurance and it got stolen, no police report, later involved in an accident?

My car got stolen and I called the police and told him but I think the title was in the car and hence I could not prove that the car was mine at that time. But the police took some details and left and sadly I thought I had filed a report. But later an adjuster from another insurance company called me and told me that my car was involved in an accident and also they got the id of that guy and the accident report was filed and the adjuster from the other company gave me a copy of it. Although my car was unregistered I had taken insurance to get it ready for registration when my car got stolen from my driveway. The person who got hit by my car had collision coverage, but her insurance co is after me. will my insurance cover my liability even if no police report of theft? Can i file a report for my car stolen now? Will I be sued for the injury? Can I find 911 call log to show I did call the cops to report my car stolen (I have a couple of witnesses)? I am just a student

  2. find your bill of sale get as many proofs of insurance (that you paid the insurance) talk to your insurance agent get all of what you just said in writing bring all of the above to a lawyer and talk to him. chances are your probably going to small claims court but still TALK TO THE LAWYER!
  3. Contact the police again, and explain what happened. I would assume that they would question the guy who was involved in the accident with your vehicle. Anyway, if the police do not take a stolen vehicle report, you may have a problem. Contact your insurance company, and report the loss. Explain to them what happened. The insurance company will have the vehicle inspected. They will look to see if the ignition was defeated. I hope that you do not keep a spare key in the vehicle. Can you account for all of the keys? Did you know how many copies you have? You may have to sign a sworn statement saying that the operator of the vehicle did not have permission to use the vehicle. The insurance company will either deny the claim against you, since the person operating the vehicle did not have permission to use the vehicle. If they are not satisfied that the vehicle was actually stolen or being operated without permission, they will likely accept the liability claim against you. They will pay for the property damage, and if she was injured they will handle the claim and/or lawsuit. Good Luck - just be upfront and honest with the cops and your insurance company.
