Jail time???

My boyfriends sister and her soon to be ex husband are going through a nasty divorce. About three months ago her husband moved out and started cancelling everything...car insurance, health insurance on her oldest (15) of her 4 sons who is sick with lymes disease and fibromyalgia. He downgraded the phone service also so she didn't have long distance. She called the phone company to get the service back and put into her own name since he was no longer living there. They told her that he would have to call to make those changes. Sooooo my boyfriend acted as him and called and used the last 4 digits of his SS # to change the account into his sisters name. The next day her ex found out that the service had not been cancelled and he called the police. They both got arressted and charged with identity theft in the 3rd degree. They have never been in trouble before this. Do you think that they will get jail time? The max sentence is up to 1 year in jail and or $1000 fine.. Please help...

  3. Thats hard to determine. I would hire a good attorney and tell them all the facts of this case.
