If I know who stole my credit card number...what can I do?

Today we were the victims of identity theft. We filed a police report, placed fraud alert on our credit reports and of course cancelled the debit card in which was involved. The detective at the police station was able to find the name of the people, since they ordered clothing at a major retailer and so I actually have the name and address and phone number of the jerks who did it. Can I pursue legal action? Most people never find out who does this...but I have the freaking couples address! What can I do legally and is it worth it? Total amount lost is a little over $1000 cold hard cash...as it was our debit card direct from our account. Luckily we have identity theft insurance but the deductible is still $250. Help!

  1. If the detective is already aware of this, I would think he has already filed a report with the prosecutor. You will want to call him and make sure. Seeing he is the one most familiar with this case, he is the one that can best answer your question.

  3. GET A SEARCH WARRANT CONFISCATE THE MERCHANDISE. LET THE POLICE FIND THEM AT HOME SO THEY CAN GET ARRESTED TAKE THEM TO COURT SUE FOR FRAUD, HOW THIS NEGATIVELY IMPACTED UR FAMILY, INCOME CREDIT ALL THAT GOOD $H!t

  6. Your bank will re-imburse you for fraud if you reported it promptly which it appears you did. There should be no deductible. Call your bank. That being said, what makes you think the people gve a real name or address? The police will pursue it, but if it is not local, and since it is a smallamount of money which you wil recover, I would not expect much action on it. In the mean time it wil sit in various databases until a pattern is discovered *and* a case that will stand up in court can be made. When that is is not for you to decide.
  7. If you can prove it and you have the name and address, and you lost money that has not been credited back to your account by the bank, you could sue. If you are only out $250, it may or may not be worth the effort. Go to small claim court only; to sue in any other court will probably cost more than $250 in lawyer's fees.
  8. CALL THE POLICE!!!!! AND TELL THEM WHAT HAPPENED!!!
