I was divorced 6 yrs. ago, and now my ex is pressing charges of ID Theft?
we were still married when I opened an account under his name with his permission, is this considered ID Theft. I don't have proof that he gave me permission, so should I be concerned....being that we were still married?

- If you were still married at the time you opened the account and you have been using it for the past 6 years I doubt that he has a case.

- No!! your not in the wrong and if he's saying so , then play his bluff. By using his name, do you mean his surname. If its his surname and even if you had been divorced at the time, he has no claims to I.D theft, you still have the right to call yourself by his surname.
- It doesn't sound like ID theft, but you probably should have closed (or asked him to close) the account at the time of the divorce, or at least not used it after the divorce. You may not have proof that he gave you permission to open the account, but he certainly saw the bills and paid them when you were married, thereby showing the court that he accepted the account as legitimate and by default, gave you permission to use it. I would not continue to use the account now, though. By law, it's his account and he has to pay for it, but you could be liable for the things you purchased after the divorce. Better get some legal advice. Good luck.
